This Terms of Service agreement (the "Agreement") is a legal contract between Sole Proprietor Liliia Vasylenko (the "Provider") and any individual who accesses or uses the services (the "Member"). By purchasing a Membership or accessing the Platform, you agree to be bound by these terms.
1. DEFINITIONS● Site: The website located at https://limaxsport.com.● Platform: The Provider’s proprietary software complex, including tools for tracking progress, interactive timers, and content management.● Platform Services: Granting access to the Platform’s functional features based on the purchased Membership.● Coach: A fitness professional (either the Provider or a Partner Coach) who creates Content for the Member.● Partner Coach: An independent third-party contractor who uses the Platform to provide their own services. They are not employees or representatives of the Provider.● Coaching Services: Personalized information and consulting services provided by a Coach to a Member. These are governed by separate agreements between the Coach and the Member.● Content: All materials on the Platform, including workout plans, video demonstrations, articles, and meal plans.● Membership: A time-limited right to access Platform Services, paid in advance.● Acceptance: The full and unconditional acceptance of this Agreement, confirmed by the act of payment.
2. SCOPE OF SERVICES2.1. Platform Access: This Agreement governs the technical access to the Client Portal for the duration of an active Membership.2.2. IMPORTANT DISCLAIMER: This Agreement DOES NOT govern Coaching Services. All financial and contractual relationships regarding personal coaching are subject to separate arrangements between the Member and their chosen Coach.2.3. Technical Requirement: An active Membership is a technical prerequisite for receiving Coaching Services through the Platform interface.2.4. Coach Availability: A Membership grants access to the Platform’s tools, not a guarantee of a specific Partner Coach's availability. If a Partner Coach terminates their relationship with the Platform:● Members can usually continue their current program until the Membership expires.● If continuation is impossible, the Member may choose a refund for the unused period or immediate transition to another Coach or AI-generated plans.
3. PAYMENTS AND FEES3.1. Pricing: Membership fees are published on the Site and are subject to change.3.2. Prepayment: All services are provided on a 100% prepayment basis via LiqPay.3.3. Taxes: Members are responsible for any local taxes applicable to their purchase.
4. DIGITAL DELIVERY4.1. Delivery of Service: For digital services, "delivery" is defined as granting login access to the Client Portal. This occurs immediately or within 24 hours of successful payment.
5. REFUND POLICY5.1. No Refunds: Due to the digital nature of the Platform Services and immediate access to proprietary Content, all sales are final. No refunds will be issued for partially used Membership periods.5.2. Technical Exceptions: A refund may be requested only if the Provider fails to grant access due to technical issues within 24 hours of payment and fails to resolve the issue within a reasonable timeframe after being notified.
6. HEALTH AND SAFETY DISCLAIMER (CRITICAL)6.1. ASSUMPTION OF RISK: PHYSICAL EXERCISE IS INHERENTLY RISKY. BY USING THE PLATFORM, YOU VOLUNTARILY ASSUME ALL RISKS OF INJURY, ILLNESS, OR DEATH.6.2. CONSULT A PHYSICIAN: YOU MUST CONSULT WITH A LICENSED PHYSICIAN BEFORE STARTING ANY NEW EXERCISE OR NUTRITION PROGRAM.6.3. NO MEDICAL ADVICE: THE CONTENT ON THE PLATFORM IS FOR INFORMATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.6.4. NO GUARANTEE OF RESULTS: RESULTS DEPEND ON INDIVIDUAL EFFORT, GENETICS, AND CONSISTENCY. THE PROVIDER MAKES NO GUARANTEES REGARDING SPECIFIC PHYSICAL OUTCOMES.
7. AI PERSONALIZATION AND DATA7.1. Gemini AI Integration: The Platform uses Google Gemini AI to generate personalized plans and analyze performance.7.2. De-identified Data: You agree that de-identified (anonymous) profile data (age, weight, goals, performance) may be processed by Google AI Studio to improve service quality. No personally identifiable information (Name, Email, Phone) is shared with AI partners.
8. INTELLECTUAL PROPERTY8.1. Ownership: The Platform’s code, design, and structure are the exclusive property of the Provider.8.2. Restrictions: Members may not copy, distribute, or share Platform Content with third parties. Sharing account credentials is strictly prohibited and may result in immediate termination without a refund.
9. LIMITATION OF LIABILITY9.1. Third-Party Coaches: The Provider is a technical facilitator and is not liable for the quality, safety, or effectiveness of Coaching Services provided by independent Partner Coaches.9.2. Platform Availability: While we strive for 100% uptime, the Provider is not liable for temporary service interruptions due to maintenance or third-party infrastructure failures.
